Contractual Compliance under the Building Safety Act – Drafting, Negotiating and Enforcing Contracts

This session will handle the considerations for businesses entering into construction-related contracts against the backdrop of the Building Safety Act 2022, and provide guidance and tips on drafting from the point of view of contractors and consultants.
We will explore the types of contract that will be affected and how drafting seeks to tackle the roles of duty holders, managing the “golden thread” and the extended BSA-related liability periods.
The session takes into account; the lifecycle of the project, from procurement to completion, and the duties which may endure post-completion; the insurance position vs. the risk, and explore offsetting potential coverage risks; the effect on commercial activities when gateway approvals create delays and cost and how to manage this within the drafting.
The aim of this session is to promote confidence in construction contracts generally and to provide useful advice in identification (and resolution) of risk to take forward.
